The Arizona Attorney General’s Office State Government Division/Transportation Section is seeking a Construction/Condemnation Assistant Attorney General.

This position may offer the ability to work remotely, within Arizona, based upon the department's business needs and continual meeting of expected performance measures.

Job Duties:

While the position's working title is "Construction/Condemnation Attorney", the attorney will actually provide legal services and advice to the Department of Transportation on a variety of legal subjects including construction law, eminent domain law, property law, contracts and other areas of law as assigned. The attorney will be responsible for handling all phases of complex litigation involving real property acquisition and construction contract disputes. Additional matters will include, but are not limited to, relocation issues, encroachments and other right-of-way issues, property management issues, interpretation of any statutory of regulatory provisions relevant to ADOT activities, and review of proposed legislation or administrative rules.

The attorney will also be responsible for advising ADOT in regard to procurement and other contract issues. These will include Intergovernmental Agreements, lnter-agency Service Agreements, Joint Project Agreements, Grant Agreements as well as Requests for Proposals from, and contracts of varying types with, private entities. The attorney will be available to advise and consult with other attorneys in the Section on contract issues, and will represent ADOT in all stages of litigation which may result from contract disputes. Interpretation of relevant statutory and administrative regulations, as well as review and provision of legal advice on proposed legislation or regulations will be required.

Knowledge, Skills & Abilities (KSAs):

-Knowledge and understanding of applicable statutes; case law; and court rules.

-Knowledge of administrative rules and regulations.

-Knowledge of Arizona rules of civil and criminal procedure.

-Knowledge of the general principles of administrative law, contracts, procurement and public records law.

-Skill in persuasive oral and written communication pertaining to case presentation through various stages of representation, including litigation through trial and appeal if required.

-Skill in interpersonal relations necessary for effective team work, cooperation and conflict resolution.

-Ability to recognize legal issues, presented by specific factual situations and to perform necessary legal research and analysis related to those issues.

-Ability to exhibit good judgment in evaluation and analyzing diverse legal issues.

-Ability to display courteous and professional behavior.

Selective Preference(s):

Prior experience in civil litigation, civil trial work and civil motion practice.

Pre-Employment Requirements:

• Travel is required for this position. A valid Arizona Driver’s License is required, along with consent to have your driving record run periodically.

• Admission to, and good standing with, the Arizona State Bar is required (include on resume the date(s) of admission in Arizona and any other states). Candidate must have an active Arizona State Bar license.

• Attorney applicants are required to submit a writing sample with their resume/application profile.

The writing sample should contain an analysis of some substantive legal issue and provide insight concerning your ability to think and to explain and advocate for a particular position.
